Business Terms of Service

These Terms of Service (Terms) govern your access to and use of AusLanka Business Directory's website and business directory services (Service). By accessing or using the Service, you agree to these Terms.

If you are using the Service on behalf of a business or other organisation, you represent that you are authorised to bind that entity to these Terms.

These Terms apply in addition to our Privacy Policy.

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must promptly notify us of any unauthorised use of your account.

The Service allows businesses to create and manage public listings and related content (for example: posts, deals, menus, products, services, events, images, and other materials) (Business Content).

You agree that Business Content you publish must:

• be accurate, not misleading, and not deceptive;
• comply with applicable laws (including Australian Consumer Law);
• not infringe intellectual property, privacy, or other rights of any person;
• not contain unlawful, hateful, harassing, or otherwise prohibited content.

You are solely responsible for Business Content you publish and for your interactions with users who contact you.

The Service may display reviews, ratings, and other user-generated content. We do not verify all content for accuracy. Where available, we may provide tools to report content that is unlawful or violates these Terms.

You must not:

• use the Service for any unlawful purpose;
• attempt to gain unauthorised access to systems or accounts;
• interfere with or disrupt the Service (including via scraping, bots, or automated harvesting);
• upload malware or attempt to bypass security or rate limits;
• impersonate any person or misrepresent your affiliation with a business.

We (and our licensors) own the Service, including its software, design, and branding, excluding Business Content.

You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and distribute your Business Content as necessary to operate, promote, and improve the Service.

We may (but are not obliged to) monitor, remove, or restrict access to content that we reasonably believe violates these Terms, is unlawful, or could harm users or the Service.

The Service may include links to third-party websites or services. We are not responsible for third-party content, products, or services. Your use of third-party services is subject to their terms and policies.

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.

We do not guarantee the accuracy of listings, availability of goods or services, or outcomes from using the Service.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or other applicable law that cannot be excluded, restricted, or modified.

To the extent permitted by law, our liability is limited (at our option) to re-supplying the Service or paying the cost of having the Service supplied again.

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or opportunities.

You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses (including legal fees on a solicitor-client basis) arising out of or related to your use of the Service or your Business Content, including any breach of these Terms.

We may suspend or terminate your access to the Service if we reasonably believe you have breached these Terms, or if required for security, legal, or operational reasons.

You may stop using the Service at any time. Some provisions of these Terms will survive termination (including intellectual property, disclaimers, limitations of liability, and indemnities).

These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia and the state or territory in which we are established.
